End User License Agreement

END-USER LICENSE AGREEMENT (EULA) FOR THIS PRESENTATION (DaVinci-Presentation_PC.ppt and/or DaVinci-Presentation_Mac.ppt, and/or DaVinci-Presentation_Span.ppt, and/or DaVinci-Presentation_Span_Mac.ppt version 1.0)

IMPORTANT—READ CAREFULLY: This End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Faith Studies International, for the software product identified above, which includes computer software and may include associated media, printed materials, and “online” or electronic documentation and/or updates.

By installing, copying, or otherwise using the PRESENTATION, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the PRESENTATION.

PRESENTATION LICENSE
The PRESENTATION is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

The PRESENTATION is licensed, not sold.

1. GRANT OF LICENSE. This EULA grants you the following rights:
--Installation and Use. You may install and use the PRESENTATION on a computer for the sole purpose of using the PRESENTATION as originally intended.
--Ownership of the PRESENTATION remains with Faith Studies International. You are granted specific and limited permission to use the PRESENTATION for Christian ministry purposes.
--Backup of Original. You may also install and retain an original copy of the PRESENTATION as a starting point for event-specific customization.

2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
--Customization. You may modify the PRESENTATION for your own personal use, and as appropriate for different audiences and events, with the following exceptions. You may NOT change the intended purpose and meaning of the PRESENTATION. You may not remove the FaithSearch copyright nor the FaithSearch logo from the presentation. You may not represent the presentation as your own, or in any way hide or disguise that this is a copyrighted work of Faith Studies International. You may use the PRESENTATION in part or in whole as needed for a particular event.
--Duplication. You may NOT install the PRESENTATION on more than one computer EXCEPT for temporary installation that may be necessary for the purpose of a specific presentation event. In that case, the installed temporary copy MUST be removed immediately upon completion of the presentation.
--You may NOT distribute or re-distribute in any way or form, in whole or in part, this PRESENTATION. You may NOT sell, lease, copy or reproduce this PRESENTATION.
--Termination. Without prejudice to any other rights, Faith Studies International may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the PRESENTATION. Faith Studies International may also terminate this license upon written notice at any time and for any reason.

3. COPYRIGHT. The PRESENTATION contains proprietary, intellectual property of Faith Studies International. All title and copyrights in and to the PRESENTATION (including but not limited to any original images, photographs, animations, video, audio, music, and text incorporated into the PRESENTATION), the media containing the original PRESENTATION, and any copies of the PRESENTATION are solely owned by Faith Studies International. Copyrighted materials included in the PRESENTATION as attributed to other sources remain the copyright of their original, respective holders, and are used under the provisions of the copyright laws. The PRESENTATION is protected by copyright laws and international treaty provisions. Therefore, you must treat the PRESENTATION like any other copyrighted material except that you may install the PRESENTATION on a single computer provided you keep the original solely for backup or archival purposes.

MISCELLANEOUS
This EULA is governed by the laws of the State of Minnesota.

4. DISCLAIMER OF WARRANTIES. To the maximum extent permitted by applicable law, Faith Studies International provides the PRESENTATION AS IS AND WITH ALL FAULTS, and hereby disclaim all warranties and conditions, either express, implied or statutory, including, but not limited to, any (if any) implied warranties or conditions of merchantability, of fitness for a particular purpose, of lack of viruses, of accuracy or completeness of responses, of results, and of lack of negligence, all with regard to the PRESENTATION, and the provision of or failure to provide Support Services. ALSO, THERE IS NO WARRANTY OR CONDITION OF TITLE, QUIET ENJOYMENT, QUIET POSSESSION, CORRESPONDENCE TO DESCRIPTION OR NON-INFRINGEMENT, WITH REGARD TO THE PRESENTATION. THE ENTIRE RISK AS TO THE QUALITY OF OR ARISING OUT OF USE OR PERFORMANCE OF THE PRESENTATION AND ASSOCIATED FILES, IF ANY, REMAINS WITH YOU.

5. EXCLUSION OF INCIDENTAL, CONSEQUENTIAL AND CERTAIN OTHER DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAITH STUDIES INTERNATIONAL BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS OR CONFIDENTIAL OR OTHER INFORMATION, FOR BUSINESS INTERRUPTION, FOR PERSONAL INJURY, FOR LOSS OF PRIVACY, FOR FAILURE TO MEET ANY DUTY INCLUDING OF GOOD FAITH OR OF REASONABLE CARE, FOR NEGLIGENCE, AND FOR ANY OTHER PECUNIARY OR OTHER LOSS WHATSOEVER) ARISING OUT OF OR IN ANY WAY RELATED TO THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, OR OTHERWISE UNDER OR IN CONNECTION WITH ANY PROVISION OF THIS EULA, EVEN IN THE EVENT OF THE FAULT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF CONTRACT OR BREACH OF WARRANTY OF OR ANY SUPPLIER, AND EVEN IF OR ANY SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. LIMITATION OF LIABILITY AND REMEDIES. Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of and any of its suppliers with regard to the PRESENTATION or this EULA and your exclusive remedy for all of the foregoing shall be limited to U.S.$1.00. The foregoing limitations, exclusions and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.
